ARTICLE 1: DECLARATION TO THE APDP

In accordance with the law 2017-20 of April 20, 2018, relating to the digital code in the Republic of Benin (Book 5 on the protection of personal data and privacy), the website has been declared to the Personal Data Protection Authority (APDP) under registration number RD No. 005-2021/APDP/Pt/SG/DAJC/SA of February 3, 2021. In any case, the company "URBAN TECHNOLOGY" SARL only collects personal information from users for the purpose of the services offered by the fastermessage website. Users provide this information knowingly, especially when they enter it themselves. In accordance with the provisions of the law 2017-20 of April 20, 2018, on the digital code in the Republic of Benin, every user has the right to access, rectify, and oppose the personal data concerning them by making a written and signed request, accompanied by a copy of an identification document with the signature of the document's holder, and specifying the address to which the response should be sent. No personal information of fastermessage website users is published, exchanged, transferred, assigned, or sold to any third party without the user's knowledge or consent.

ARTICLE 2: RIGHT OF ACCESS

Under this law, Internet users have the right to access, rectify, modify, and delete data concerning them personally. This right can be exercised by mail with the company "URBAN TECHNOLOGY" SARL or by email at the following address: faster@fastermessage.com. The personal information collected is never entrusted to third parties.

ARTICLE 3: CONFIDENTIALITY

Article 3.1: PROCESSING OF PERSONAL DATA

In accordance with the provisions of Article 383 of Law No. 2017-20 of April 20, 2018, on the digital code in the Republic of Benin, as amended by Law No. 2020-35 of January 6, 2021, user data is:

  • Processed lawfully;
  • Collected, recorded, processed, stored, and transmitted in a lawful, fair, transparent, and non-fraudulent manner;
  • Collected for specific, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes, taking into account all relevant factors, including the reasonable expectations of the data subject and the applicable legal and regulatory provisions;
  • Adequate, relevant, and not excessive in relation to the purposes for which they are collected and processed;
  • Accurate and, if necessary, kept up to date. All reasonable measures must be taken to ensure that inaccurate or incomplete data, with regard to the purposes for which they are collected or for which they are subsequently processed, are erased or rectified;
  • Stored in a form that allows the identification of the individuals concerned for a duration not exceeding that necessary for the purposes for which they are collected or processed. Personal data may be stored for longer periods to the extent that they will be processed exclusively for archival purposes in the public interest, for scientific or historical research purposes, or for statistical purposes in accordance with Article 396 of Law No. 2017-20 of April 20, 2018, on the digital code in the Republic of Benin, as amended by Law No. 2020-35 of January 6, 2021, provided that appropriate technical and organizational measures required by the provisions of this Book are implemented to guarantee the rights and freedoms of the data subject;
  • Processed in a manner that ensures appropriate security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures.

It is the responsibility of the data controller to ensure compliance with the first paragraph.

The collection and processing of user data on the fastermessage website comply with the principles set out in Articles 384 and following of Law No. 2017-20 of April 20, 2018, known as the Digital Code in the Republic of Benin, as amended by Law No. 2020-35 of January 6, 2021.

The personal data collected on the fastermessage website are as follows:

  • Name and first name or corporate name of the user;
  • User's addresses.

This data is collected when the user registers on the website or decides to contact the publisher via the website. The data controller will keep all the data in its computer systems on the website and under reasonable security conditions for a minimum period of one (01) year, unless the user is informed and requests deletion before the expiration of this period.

When personal data is recorded, the user is informed of the duration for which their data will be retained, and when this duration cannot be specified, the website publisher informs the user of the criteria used to determine it.

The collection and processing of data serve the following purposes:

  • Identification data is used to generate invoices for clients;
  • Location data is used to contact the client for service offers.
