This policy describes how URBAN TECHNOLOGY, publisher of the FasterMessage platform, collects and processes personal data, in accordance with Law No. 2017-20 of April 20, 2018 establishing the Digital Code of the Republic of Benin and under the supervision of the Personal Data Protection Authority (APDP).
Data controller
The data controller is URBAN TECHNOLOGY (SARL registered RB/COT/16 B 15170, registered office in Abomey-Calavi, Zogbadjè area, Latifou GBODJI house, Benin), publisher of the fastermessage.com website. The processing has been declared to Benin's APDP under number RD No. 005-2021/APDP/Pt/SG/DAJC/SA of February 3, 2021, in accordance with Law No. 2017-20 establishing the Digital Code.
Our roles: data controller & processor
URBAN TECHNOLOGY acts as a data controller for the data required to manage your account, billing and the customer relationship. When you use the Platform to send messages, URBAN TECHNOLOGY acts as a data processor for your recipients' data and the content of your messages: these data are processed only on your instructions and solely to provide the services. As a customer, you remain the data controller of your recipient database and warrant the lawfulness of its collection (consent or another legal basis).
Data collected
We collect the data you provide through the website forms, account creation or orders:
- Identification & account data: first and last names, company name, trade register number, IFU, email address, login credentials.
- Commercial data: industry, volumes, channels of interest, the content of your messages to customer service.
- Billing data: top-ups, transactions, consumption history.
- Technical data: browsing history, connection logs, IP address, relationship-tracking data.
- Your recipients' data (processed as a data processor): the contact details you import and the content of the messages you send.
Purposes & legal bases
Your data is used to: manage and track orders, billing and collection, complaints and after-sales follow-up, create and manage your account and provide the services (performance of the contract); comply with our accounting, tax and regulatory obligations, and respond to requests from the authorities (legal obligation); improve website performance, carry out statistical analyses, secure the Platform and combat fraud (legitimate interest); where applicable, send you communications to which you have consented (consent). Your data is neither sold nor shared with third parties for commercial purposes.
Recipients & processors
Your data may be shared with URBAN TECHNOLOGY's authorized staff and processors (IT services, payment providers, hosting, telecom carriers and messaging providers such as Meta/WhatsApp for message routing, statistical consulting), as well as with the authorities where the law requires. These third parties are bound by equivalent confidentiality and security obligations.
Transfer outside Benin
As hosting is provided by DigitalOcean, LLC (a company incorporated under U.S. law), your data is hosted in its Amsterdam, Netherlands data center (AMS3 region), and is thus transferred outside Benin, in compliance with appropriate safeguards within the meaning of the Digital Code. Other transfers may occur to routing providers located outside Benin.
Security
URBAN TECHNOLOGY implements appropriate technical and organizational measures (access encryption, authorization control, logging, backups) to preserve the security and confidentiality of your data and protect it against any destruction, loss, alteration or unauthorized access. In the event of a data breach likely to create a risk to your rights, the persons concerned and the APDP are informed under the conditions provided for by law.
Retention
Data is retained for the duration of the contractual relationship. Billing and accounting data is archived for ten (10) years in accordance with legal obligations; other personal data is retained for the time necessary for the purposes pursued, then deleted or anonymized.
Your rights
You have the right to access, rectify, erase, restrict, object to and port your data, the right to withdraw your consent at any time and to define post-mortem instructions. To exercise them, write to [email protected]; proof of identity may be requested. If you consider that your rights are not respected, you may refer the matter to the APDP (www.apdp.bj).
Minors
The services are intended exclusively for professionals. The Platform is not aimed at minors and does not knowingly collect their data.
Cookies
The website uses cookies and trackers for proper operation, audience measurement and improving the user experience. Cookies strictly necessary for the website to function are set without consent; measurement and personalization cookies require your prior agreement. You can configure or withdraw your choice from your browser at any time.
Changes to the policy
This policy may be updated to reflect legal, technical or service developments. The applicable version is the one published on this page; in the event of a substantial change, you will be informed by an appropriate means.
